If you’re an employee of Cinemark, you should’ve gotten an email with a long document involving a program called resolve.
- “In exchange for the offer of employment extended to YOU by Cinemark, and/or YOUR continued employment with Cinemark, along with the mutual promises in this Arbitration Agreement, YOU and Cinemark agree that any controversy between YOU and Cinemark (including agents of Cinemark and its subsidiaries) that arise out of YOUR employment or the termination of YOUR employment shall be settled by binding arbitration.”
That’s from the first paragraph of the document. It’s basically saying if something happens where you need to involve a legal court, instead they will handle it internally.
BASICALLY meaning you can’t sue Cinemark. There are a few exceptions I think but not many.
- “This Arbitration Agreement is intended to be broad and to cover, to the extent otherwise permitted by law, all employment-related disputes between YOU and Cinemark including, but not limited to, disputes arising out of federal and state statutes and local ordinances, such as: Title VII of the Civil Rights Act of 1964, as amended; Civil Rights Act of 1866; Sarbanes-Oxley Act of 2002; Dodd-Frank Act; Equal Pay Act; Fair Labor Standards Act; Pregnancy Discrimination Act; Family Medical Leave Act; Americans with Disabilities Act; Fair Credit Reporting Act; and any similar federal, state and local laws. ”
The only way to not agree to giving up your ability to sue, is a page at the very end of the document.
